Measmerize solutions are developed, owned and operated by Measmerize LTD and its subsidiaries ("Measmerize", "we", "our", "us"), registered in England with Companies House registration number 10644664 and whose registered address is 2 HAMPTON COURT ROAD BIRMINGHAM.

Terms of Service

By using our corporate website and any of its subdomains and other of our applications (collectively referred to as "Website") and the Measmerize widget (the "Widget") you accept these Terms of Service ("terms"). Please read these terms carefully before doing so. We reserve the right to amend any or all terms of service at our sole discretion and without prior notice. Your continued use of the Website and the Widget following any such amendment indicates your acceptance of such amended terms. We reserve the right to amend, modify or discontinue, suspend or restrict access to any part/s of this website without notice.

Except as expressly provided otherwise in a written agreement between you and Measmerize, the Website, the Widget and any content or materials contained herein are provided as is and without warranties of any kind. Measmerize and each of its present and future directors, officers, shareholders, employees, contractors, agents, subsidiaries and affiliates and their respective heirs, successors and assigns shall not be liable for any special, indirect, incidental, punitive or consequential damages that result from the use of, or the inability to use this website.

No advice or information, whether written or oral, obtained by you from us or from or through the Website or the Widget shall create any warranty not expressly stated otherwise in these Terms, neither with Measmerize nor with our commercial partners from which the Website or the Widget is being accessed.

We, or our commercial partners from which the Website or the Widget is being accessed, do not warrant that the features or functions of the Website or the Widget will be uninterrupted or error-free. Our commercial partners from which the Widget is being accessed issue no warranties regarding the availability and/or quality of the services and any claim in connection with the services shall be addressed at Measmerize.

We make no representation that the content of the www.measmerize.com domain or its subdomains are appropriate or legal for use in your location or jurisdiction. You agree that you are accessing this on your own initiative and that you are responsible for compliance with local laws wherever such laws apply.

Measmerize uses Artificial Intelligence technologies. The Widget comprises artificial intelligence technologies in order to provide certain functionalities and services to users, including:

  • a) Size recommendation services consist of machine learning algorithms. The size recommendations generated by the Widget are produced through automated statistical, probabilistic and machine-learning processes based on information provided by you and on product-related information made available to Measmerize. Any recommendation generated by the Widget is intended solely as an indication to assist you in evaluating product sizing and fit. Recommendations do not constitute professional advice, do not create any warranty regarding product suitability and should not be regarded as a guarantee that a particular product will fit you. You remain solely responsible for any purchasing decision and may disregard any recommendation generated by the Widget;
  • b) Body scanning functionalities deploy computer vision systems in connection with the size recommendation services. Where the Body Scanning functionality is used, photographs uploaded by you are analysed by machine learning algorithms and computer vision technologies to estimate body measurements and generate a digital model of your body for size recommendation purposes. You acknowledge and agree that body measurement estimates generated through such functionality are based on algorithmic calculations and approximations and may not correspond to actual physical measurements. Measmerize does not represent or warrant that any measurement, estimate or recommendation generated through the Body Scanning functionality is complete, accurate, error-free or suitable for any specific purpose. You remain solely responsible for any purchasing decision and may disregard any recommendation generated by the Body Scanning functionality in connection with the Widget;
  • c) Virtual Try-On experiences: based on generative artificial intelligence models. Users acknowledge that images, avatars, digital representations, simulations, visualisations and videos generated through such functionality are created wholly or partially through generative artificial intelligence technologies. The Virtual Try-On functionality is intended solely to provide a simulated visual representation of how products may appear on a user and does not represent an actual image, recording or depiction of reality. Any image, avatar, digital twin, animation, video or other output generated by the Virtual Try-On functionality may differ from your actual appearance and may differ from the actual appearance, colour, texture, dimensions, fit, movement or characteristics of any product. You are therefore informed that any image, animation or video generated through the Virtual Try-On functionality constitutes AI-generated content. You remain solely responsible for any purchasing decision and may disregard any recommendation generated by Virtual Try-On functionality in connection with the Body Scanning functionality and/or the Widget.

The machine learning algorithms and computer vision systems are developed by Measmerize whilst the generative artificial intelligence models may be partially or entirely provided by selected third-party open technology providers. To the maximum extent permitted by applicable law, Measmerize does not control and shall not be responsible nor liable for interruptions, errors, inaccuracies or limitations attributable to the third-party open source generative artificial intelligence models. The artificial intelligence technologies used by Measmerize are designed to support users in evaluating product size and fit, and do not make decisions producing legal effects concerning you or similarly significant effects. Any recommendation, output, visualisation or simulation generated by the Widget is non-binding and may be accepted, disregarded or modified by you at any time.

By accessing or using the Widget and the virtual try-on experience, you acknowledge that you are interacting with functionalities that are wholly or partially powered by artificial intelligence technologies. When you upload any photograph, image or other content to the Widget, you represent and warrant that:

  • a) you are legally entitled to provide such content and to permit its processing by Measmerize;
  • b) such content does not infringe any intellectual property right, privacy right, publicity right or other right of any third party;
  • c) any individual depicted in such content is entitled to and has provided any authorisation or consent required under applicable law;
  • d) you understand and agree that such content may be processed through artificial intelligence technologies for the purposes described in these Terms of Service and in the Privacy Policy.

Links to external websites outside of Measmerize's control do not imply any endorsement of either the external website or any product available on them. We are not responsible for the content or accuracy of the information on such websites.

If at any time you make any submissions via the website, including but not limited to comments, suggestions, bug reports and feature ideas, you assign all rights in these submissions to Measmerize. We shall exclusively own all now known or hereafter existing rights to the submissions throughout the universe in perpetuity and shall be entitled to use the submissions for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the submissions. In any event, any submissions you send will not be treated as confidential and we shall not be liable for any disclosure of the submissions.

These terms are governed by the laws of England. Should a court of competent jurisdiction find any provision or portion of these terms to be unenforceable, the remainder of the terms included herein will continue with full force and effect.
